Yeti Confetti Kids Terms of Use (Schools Version for the U.S.)

1. Introduction

These Terms of Use (“Terms”) govern your access to and use of the Yeti Confetti Kids platform (“Service”), provided by Lirvana Labs, Inc. (“Company,” “we,” “us,” “our”), under the laws of the State of California. By using our Service, you agree to these Terms. We may update these Terms periodically, so please check them regularly, as continued use of the Service signifies your acceptance of any changes.




2. Eligibility

You must be at least 18 years old to use Yeti Confetti Kids, or you must have the consent of a parent or legal guardian if you are under 18. Parents and guardians are responsible for monitoring their child’s use of the platform and agree to the collection and use of information as outlined in our Privacy Policy.




3. License to Use the Platform

We grant you a limited, non-exclusive, non-transferable license to access and use Yeti Confetti Kids, provided you comply with these Terms. This license is restricted to educational, non-commercial purposes, and any other use requires prior written permission from Lirvana Labs, Inc.

All content on Yeti Confetti Kids, including but not limited to text, graphics, logos, images, and software, is the property of Lirvana Labs, Inc. or its licensors and is protected by copyright, trademark, and other intellectual property laws. Users may not copy, modify, distribute, or create derivative works from any content on the platform without prior written permission.




6. Privacy

By using Yeti Confetti Kids, you confirm that you have read and understand our Privacy Policy and agree to the collection and use of data in accordance with the Privacy Policy. Schools are responsible for obtaining any necessary parental consent required under COPPA for users under 13 years of age.




7. Termination

We reserve the right to suspend or terminate your access to Yeti Confetti Kids without prior notice if you violate these Terms or any applicable legal, governmental, or regulatory requirements. Upon termination, your right to use the Service will cease immediately. Any data associated with a terminated account will be handled in accordance with our Privacy Policy.




8. Student Data and Retention Policy

Student’s Personally Identifiable Information (PII) are under the direct control of the school. During arrangement with Lirvana Labs, the school remains in control of the Student’s PII. While we maintain standard retention periods as outlined below, schools can request these at any time.

Upon request from a school administrator or under applicable legal standards, we will delete student PII data in accordance with FERPA and related laws. Upon account termination or contract completion, student data will be retained for one year post-termination. Furthermore, inactive student data will be retained for one year after which, schools will receive a 30-day advance notice through email before deletion. In the case of bankruptcy, merger, acquisition and asset sale of Lirvana Labs, we will provide an advanced notice before data is transferred or becomes subject to a different Privacy Policy. Schools will be given time whether to accept or reject the new policy.




9. Disclaimers and Limitation of Liability

The Service is provided on an “as-is” and “as available” basis without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose or non-infringement. We do not guarantee that the Service will be error-free, secure, or available at all times.

To the fullest extent permitted by law, Lirvana Labs, Inc. is not liable for any indirect, incidental, special, or consequential damages, including lost profits, arising out of or related to your use of the Service. In jurisdictions where limitations of liability are not permitted, our liability will be limited to the minimum extent required by law.




10. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any dispute or claim arising out of or in connection with these Terms shall be resolved exclusively in the state or federal courts located in California.




11. Changes to These Terms

We may modify these Terms periodically. We will notify the school through email about any changes to the terms 30-days prior to the changes taking effect. The most recent version will be posted on our website, and your continued use of the Service after any changes constitutes acceptance of the updated Terms.
